These Terms and Conditions (“Terms”) govern your access to and use of the Duracon Surface Solutions website (the “Site”) and any purchases you make from Duracon Surface Solutions (“Duracon,” “we,” “us,” or “our”). By accessing or using the Site, placing an order, or otherwise interacting with Duracon, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Site or purchase our products.

  • “Customer,” “you,” or “your” means any person or entity who accesses the Site or orders products from Duracon.

  • “Products” means any chemical coatings, sealants, dyes, stains, paints, or related items offered for sale by Duracon.

  • “Order” means your request to purchase one or more Products through the Site or through our physical store/common‐carrier channels.

       Eligibility

You must be at least 18 years old and have the legal capacity to enter into binding contracts to place an Order. By submitting an Order, you represent and warrant that you meet these requirements.

 2. Orders, Pricing & Payment

  1. Order Acceptance. All Orders are subject to acceptance by Duracon. We reserve the right to refuse or cancel any Order for any reason, including errors in pricing or product descriptions.

  2. Pricing. Prices listed on the Site are shown in U.S. dollars and exclusive of shipping, handling, taxes, or other fees, which will be added to your total at checkout. Duracon reserves the right to adjust prices at any time without prior notice.

  3. Payment. We accept major credit cards, debit cards, and PayPal. Payment is due at the time you place your Order. If payment cannot be authorized or is otherwise disputed, we may suspend or cancel your Order.

  3. Shipping & Delivery

  1. Methods. Retail orders ship via the carrier selected at checkout (e.g., USPS, UPS, FedEx). Bulk orders ship via common carrier.

  2. Timing. Estimated delivery windows are provided at checkout but are not guaranteed. Delays due to carrier, customs, or force majeure events are beyond Duracon’s control.

  3. Risk of Loss. Risk passes to you when Products leave our facility. You are responsible for filing any claims with the carrier for damaged or lost shipments.

  4. Returns & Refunds

  1. Online Purchases. You may return unopened, unused Products within 30 days of delivery for a full refund, less shipping costs. Contact customer service for a return authorization.

  2. Physical Store/Bulk Orders. Returns or exchanges of bulk orders require prior written approval and may be subject to restocking fees.

  3. Non-Returnable Items. Opened containers, custom-mixed products, and clearance items cannot be returned.

  5. Product Use & Safety

  1. Instructions. You must follow all label directions, Safety Data Sheets (SDS), and local regulations when handling or applying Products.

  2. Hazardous Materials. Many Products contain chemicals that may be hazardous if misused. Duracon disclaims all liability for improper use, handling, or disposal.

  3. Warranty. We warrant that our Products will conform to their published specifications. This warranty is your sole remedy; Duracon disclaims all other warranties, express or implied, including merchantability or fitness for a particular purpose.

  6. Intellectual Property

All text, graphics, logos, button icons, images, and software on the Site are owned or licensed by Duracon and protected by U.S. and international intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

  7. Limitation of Liability

To the fullest extent permitted by law, Duracon and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising from your use of the Site or Products, even if advised of the possibility of such damages. Our total liability for any claim related to these Terms or Products shall not exceed the amount you paid us in the 12 months preceding the claim.

  8. Indemnification

You agree to defend, indemnify, and hold harmless Duracon and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms or your misuse of the Site or Products.

  9. Governing Law & Dispute Resolution

These Terms and any disputes arising out of or relating to them or your use of the Site shall be governed by the laws of the State of Michigan, without regard to its conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Wayne County, Michigan.

  10. Changes to These Terms

We may revise these Terms at any time by posting the updated version on the Site. The “Last updated” date above will reflect the effective date. Your continued use of the Site or purchase of Products after any changes constitutes acceptance of the new Terms.
